COVERAGE OVERVIEW

A COMMUNITY POOL IS THE HIGHEST-SEVERITY AMENITY AN ASSOCIATION CAN OWN.

A single drowning or near-drowning event can produce a wrongful death claim that exceeds the association's primary GL limit. Diving injuries, chemical exposure, slip-and-falls on wet decking, and hot tub cardiac events add to the exposure. The GL and umbrella must be sized to the aquatic amenity — not a generic minimum.

DROWNING & NEAR-DROWNING

The highest-severity claim type. A single event can produce a verdict exceeding primary GL limits.

UNSTAFFED OPERATIONS

No lifeguard shifts the duty to signage, fencing, safety equipment, AEDs, and emergency procedures.

CHEMICAL EXPOSURE

Improperly maintained water chemistry causes skin, eye, and respiratory injuries to swimmers.

HOT TUB & SPA

Overheating, cardiac events, Legionella risk, and slip hazards on spa decking add separate exposure.

UNSTAFFED POOLS — THE DUTY SHIFTS, IT DOESN'T DISAPPEAR

NO LIFEGUARD MEANS THE ASSOCIATION'S SAFETY OBLIGATIONS INCREASE.

Most community pools operate without lifeguards. That does not reduce the association's liability — it shifts the duty from active supervision to passive safety measures. Compliant fencing and self-closing gates, depth markers at every entry point, no-diving signage, emergency phone or call station, posted pool rules, AED placement, and rescue equipment must all be present and maintained. Failure to maintain any of these creates the negligence allegation that drives pool injury claims. Kelly Insurance Group works with associations to confirm the GL and umbrella limits reflect the actual severity exposure that an unstaffed aquatic amenity creates.

COMMON QUESTIONS

POOL & SPA LIABILITY — ANSWERED.

WHAT LIABILITY DOES A COMMUNITY POOL CREATE?

Drowning and near-drowning, diving injuries, slip-and-falls on wet decking, chemical exposure, and premises liability for every user. Pool claims carry the highest severity in community association insurance.

DOES THE ASSOCIATION NEED SEPARATE POOL LIABILITY?

Pool liability is covered under the GL, but limits must account for claim severity. A single drowning can exceed standard GL limits. Umbrella above GL is essential for any association with a pool.

WHAT IS THE LIABILITY FOR AN UNSTAFFED POOL?

The duty shifts to safety equipment, signage, fencing, gates, depth markers, emergency access, and AED placement. Failure to maintain these creates negligence exposure under GL.

DOES POOL CHEMICAL HANDLING CREATE SEPARATE EXPOSURE?

Improperly maintained chemistry causes skin, eye, and respiratory injuries. Staff handling creates workers' comp exposure. Require pool service contractors to carry their own GL and workers' comp.

WHAT ABOUT HOT TUB AND SPA LIABILITY?

Additional exposure beyond pools — overheating, cardiac events, Legionella, slip hazards. Temperature monitoring, maintenance logs, and posted health warnings are essential.

DOES THE ASSOCIATION NEED POOL WAIVERS?

Waivers provide some legal protection but don't eliminate the duty to maintain a safe facility. More effective for adults than minors. GL and umbrella are the primary financial protection regardless.
