Yes. Participant injury covers injuries that occur during the active use of an attraction or ride — the specific risk of being injured by or during the activity itself. This is separate from general premises slip-and-fall liability.

Are waivers enough to protect an FEC from liability?

Waivers reduce but do not eliminate liability for an FEC. A waiver may not be enforceable for a minor in many jurisdictions, and a waiver that was not properly executed may not hold. Insurance coverage is necessary regardless of waiver practices.

Does an FEC that serves alcohol need liquor liability?

Yes. An FEC that sells alcohol to accompanying adults carries liquor liability and dram shop exposure. The presence of children in the same space as alcohol service is a specific underwriting consideration.
